In an unusual turn of events, Mickey Rourke actually was arrested because of a faulty Breathalyzer. Rourke was pinched last month for DUI after leaving a Miami nightclub when he was pulled over on his Vespa for driving erratically. Mickey failed his Breathalyzer test but claimed he only had a few drinks. Turns out, he wasn’t lying.

Rourke was given two tests that night. On the first one, he supposedly blew a blood-alcohol reading of .081, just above the legal limit. But the control test done on the machine showed that it malfunctioned on that test.
A second test, given a few minutes later, showed Rourke had a blood alcohol level of .074.

I guess Mickey has his license back now and his lawyer Michael Grieco is expecting the charges to be dropped. I’ve heard Mickey is a boozehound, so I’m actually surprised that he wasn’t hammered on this occasion. But then again, if you look like Mickey Rourke and your driving a Vespa, it’s pretty hard not to get pulled over.
