Spotted in New York: Yankee's star Alex Rodriguez looking somber as he dines in Manhattan last night. Plus, "The Insider" has the all-new video of the headline-making baseball player leaving the New York eatery where he keeps mum when the paparazzi asks him about his impending divorce.

Meanwhile, the divorce lawyer for his wife, Cynthia, says the baseball star's relationship with Madonna was "an affair of the heart" and not "sexual infidelity," People magazine reports.

Her attorney, Earle Lilly, also told People that the relationship with the pop icon "was the last straw" before she decided to file for divorce.

Cynthia filed for divorce in a Miami court on Monday, citing alleged "extramarital affairs" by her husband. In papers filed with the Miami-Dade County Family Court, Rodriguez said she decided to divorce after having "exhausted every effort to salvage" her marriage and alleged that Alex had "emotionally abandoned his wife and children."

The divorce filing came after Madonna issued a statement Sunday denying news reports that implied she was having a romantic relationship with Rodriguez. Her statement also reiterated that she has no plans to divorce husband Guy Ritchie.

Cynthia Rodriguez should be sued by Madonna. How dare she bring Madonna in to her drama. Cynthia is the one who ran away to France with the "godfather" of her children AKA the personal trainer. Hmmmm sounds like she is busy also with extra marital affairs!

In response to one of the comments- A-Rod is not a total douche. I am on A-Rod's side all the way. I don't feel the least bit sorry for Cynthia. I'm sure she is not a perfect angel. Who was it that ran away to Paris with the personal trainer and Lenny Kravitz. Bottom line leave A-Rod alone. Let him have his personal life. Stop putting his personal life on the front page of newspapers. It is no one's business what goes on in his private life.

What makes her think that she has the right to control who the kids see. Automatic shared custody unless a parent is proven unfit. She needs to get her head out of her butt and a judge needs to straighten it up.
